Question: The regular introduction of public order legislation and the inexorable increase in police powers over the last fifteen years means that all public protest has potentially become criminal activity. Discuss.

Answer: This essay is intended to discuss that whilst there is credence to the statement that due to current legislation all public protest has potentially become criminal activity and that it is solely at the discretion of the police as to whether or not protesters are liable for arrest there are systems in place to ensure that those wishing to protest peacefully and lawfully are able to do so and also to demonstrate the possible necessity for such wide sweeping powers. It is intended first to detail a brief chronology and history of some of the relevant statue from 1980 onwards in order to show the powers mentioned above. A brief description of some of the more relevant offence and means by which the police have to control public protest is also appropriate.......(short extract)
