Question: Critically examine the way the courts have interpreted Section 2 of the Law of Property (Miscellaneous Provisions) Act 1989
Answer: There has been legislation in relation to the contract for sales and dispositions of interests in land since 1677 and it is important to note that much of the legislation was simply transmogrified in 1925 as part of the Land Reform and encompassed into the Law of Property Act (of that year) and more specifically with Section 40 of that Act. Land Law itself dates as far back as the Norman Conquest (and in some respects even further than that). The feudal system in place then is in many respects still in force now and although, the Monarchy now is for all intents and purposes mostly a titular figurehead in practice we are all but tenants on Her Majesty’s Land.......(short extract)
