Answer: A large proportion of patents annually granted in the world relates to pharmaceutical products and processes. Litigation relating to those patents is also abundant, particularly in relation to biotechnology-based pharmaceuticals. The adoption of the TRIPS Agreement in 1994 has represented a historical change in intellectual property, with profound implications in the area of pharmaceutical patents. It seems relevant, therefore, to consider the developments that have occurred in that field since the entry into force of that Agreement, in January 1995.Some interesting legislative developments have taken place in the field of pharmaceutical patents in industrialised countries, as a result of the adoption of the TRIPS Agreement.
