Answer: The Human Rights Act 1998 is a piece of legislation that enables the European Convention on Human Rights to be incorporated within domestic law and become enforceable within the United Kingdom. In this regard the Human Rights Act 1998 is an enabling piece of legislation. The relationship between the Human Rights Act 1998 and the European Convention on Human Rights is that one gives effect to the other, not only in legal matters, but in issues concerning public authorities. Article 15 of the Convention permits a State to derogate from certain Articles of he Convention under circumstances such as war or other emergency.
