Question: Critically evaluate the role of expert witnesses in court. Why is their use subject to regulation?
Answer: Expert witnesses are used in court because of their superior knowledge, training or experience in a particular area. The evidence presented before the courts is sometimes complex and cannot be reliably understood and interpreted by lay persons alone. In such circumstances the merits of having an expert in the area examine the evidence and give their opinion before the court is manifest. It has the potential to provide the court will a clearer and truer picture of the evidence. It only has the potential to do so however, because as will be demonstrated their use is not unproblematic – which is why in turn it is subject to regulation.......(short extract)
