Critically evaluate developments in this area of the law with reference to the Criminal Justice and Public Order Act 1994.
Answer: It will be argued here that whilst the Criminal Justice and Public Order Act CJPOA 1994 significantly modified the ‘right to silence’ of an accused person, it cannot be said to have been abolished. In support of this position a definition of the ‘right to silence’ will be followed by an explanation of why it still exists. This essay will then go on to assess the rationale and background to the 1994 Act alongside the relative merits of the changes brought forward.......(short extract)
